Update from Bryan Ferguson - Clubs New Zealand President

As time goes by my enthusiasm for the role as President hasn’t changed. I have met and continue to meet great people as I travel around the country attending various meetings and functions. On the whole clubs seem to be in good spirits although I acknowledge this year has been tougher than previous years.

Our new manager in the South Island Keith Ballantyne who started with us mid-September will make a difference. Nothing beats having people on the ground helping with day to day issues in clubs and Keith’s experience will help as has Dave’s continues to do in the North. At the time of writing this Keith is travelling the South visiting member clubs so I am looking forward to getting an update on the health of our member clubs down there.

Kindergarten Workplace Bullying Results in $100K Payout

A bullied kindergarten teacher has been awarded almost $100,000 after the Employment Relations Authority found she was unjustifiably dismissed.

The Authority found that the teacher “Mrs T”, had been bullied by her manager who had a track record of bullying other workers.

Trial Periods on Trial - Again

There has recently (15 August 2017) been another Employment Court determination, Farmer Motor Group Limited (FMG) v. Adam McKenzie, [2017] NZEmpC 98, which determined that the termination of employment in reliance upon a trial period provision was unjustified. This determination has again emphasised the strict compliance which is required with both the legislative and contractual provisions concerning trial periods.

Women who did not reveal theft charge to new boss awarded $7000

A receptionist who failed to disclose a theft charge on her CV was awarded $7000 in compensation despite never starting her new job at a beauty clinic.

In September 2015, the woman, whose name was suppressed, accepted an offer of employment with Nelson skin clinic Enhanceskin.

New Food Act applies to clubs

Changes to the Food Act 2014 apply this year to unlicensed clubs that serve and sell food, or provide food as part of a fee. If this sounds like you, you’ll need to register under the Food Act before March 2018. If you don’t need to register, you’ll need to keep making food that’s safe and suitable.
