Following the recent confusion regarding reciprocal visiting rights Clubs New Zealand sought a legal opinion from our lawyers Quigg Partners. In seeking the opinion we asked three questions of the lawyers, below we have provided excerpts of the lawyers opinion in relation to the three questions.

Strengthening the Clubs New Zealand Network

Right from the get go, the major driver for Clubs New Zealand's data strategy has been to unite and strengthen the Clubs New Zealand network by utilising technology.
The Clubs New Zealand National Database Project and Mobile App are continuing to grow as more and more clubs and members are getting on board. We now have a number of clubs who are part the National Database and are actively promoting the app to their members, in addition to this we are receiving multiple requests every day from members wanting to sign into the app in order to access their digital membership card and find the clubs nearest them wherever their travels take them.
Giving your Clubs Constitution the Respect it Deserves

We all know a club's constitution is one of the most important documents a club has. It is effectively the contract between a club, its committee and the members. A constitution should be an up-to-date working document and will often be the first port of call in working out how to resolve an issue with members.
However, clubs are often reluctant to invest in their constitution and a number of clubs look to cut costs and had have a go at updating their constitutions themselves. We often see clubs rushing through changes to their constitutions because they have suddenly encountered an issue that had not been previously identified.

Reciprocal Rights - Clarification

Earlier this week a large number of clubs received an email from a Clubs New Zealand member club regarding recent changes and requirements being imposed upon them following the clubs recent licence renewal process.
One of the requirements imposed upon the club regards reciprocal rights and required the club to communicate directly with other clubs they wish to have reciprocal rights with and receive a response back which they will need to keep on file.

Initial Cashless Gaming Discussion

Earlier this week team members from Clubs New Zealand were invited to attend the DIA’s preliminary discussion on cashless gaming. Also, in attendance were representatives from Hospitality New Zealand, Manufacturers, Problem Gambling Foundation, Societies, GMANZ, Ministry of Health, AUT and the financial sector including the Reserve Bank.

New Zealand is incredibly fortunate to have a gambling framework that is focused on raising funds for community purposes. Approximately $2.3 billion is spent each year in New Zealand on gambling. The largest share of this, approximately $895 million, is the money spent on gaming machines located outside of New Zealand’s six casinos (gaming machines in pubs and clubs).
Personal Penalties for Breach of Employment Agreement

A recent decision considers an often asked question and is the first to provide for personal penalties against an individual for breaches of good faith. The matter, Nicholson v. Ford was an appeal by Alan Nicholson against an Authority decision finding him personally liable for breaches of good faith against Matthew Ford. Allan Nicholson was the Director, Chief Executive and a Shareholder in a dental practice, Clinico, that employed Mr Ford as an accounts administrator. Mr Nicholson wished to restructure the company that employed Mr Ford. Mr Nicholson was responsible for the redundancy process that ultimately led to Mr Ford’s dismissal.
