DIA Operational Update: Implementing the Gambling Commission's recommendation: [Appeal by Pub Charity Limited re Matata Hotel GC 03/21]

Kia ora koutou,

We agree with the Commission’s decision of March 2021 to enable corporate societies to correct the number of permitted machines listed on venue licences, and we have been exploring ways to implement the approach suggested by the Commission.

Fully implementing the recommendation requires changes to our licensing IT system, and these changes have been scoped and are in development, but due to their complex nature will not be available until early 2022.

In the interim and to ensure we progress this decision, we are offering a business solution so that additional machines can be added to the licence under certain conditions. These are:

  • Our current IT system cannot distinguish between operational and non-operational machines. If additional machines are added to the license, all will be recorded as operational.
  • The EGM annual compliance fee will be calculated in the normal way with reference to the total number of machines specified on the licence.
  • Additional machines can only be added if they are not listed on other licenses, and then only to the maximum entitlement.
  • We do not have discretion under the Regulations to waive the Class 4 annual fee or the licence amendment fee, so you will be charged the licence application fee and the annual EGM licence fee. Any machines not operating will not incur a monitoring fee.

As noted above, IT development work for the full solution is underway and will enable the recording of the permitted machines distinguishing between those that are operational/non-operational. We’re aiming for a release date in the first quarter of 2022 – we’ll keep you up to date as we progress.
